All equipment descriptions and details available on Seller’s website and in advertisements have been prepared as a guide only, based on information from sources believed to be reliable; however, their accuracy cannot be guaranteed or warranted. No sale shall be invalidated; nor shall Seller be liable as a result of defects or inaccuracies in any such descriptions and/or details. Buyer acknowledges that Seller has made equipment available for inspection prior to sale and that it is the buyer’s responsibility to inspect all equipment and to make their own inquiries and due diligence before purchasing.
ALL USED EQUIPMENT IS SOLD 'AS IS, WHERE IS'. New Equipment may be covered under a manufacturer's limited warranty.
The dealer provides NO GUARANTEES OR WARRANTIES OF ANY KIND, EXPRESSED OR IMPLIED, STATUTORY OR OTHERWISE OF ANY NATURE WHATSOEVER IN RESPECT TO EQUIPMENT. SPECIFICALLY, BUT WITHOUT LIMITATION, SELLER MAKES NO REPRESENTATION OR WARRANTY THAT ANY EQUIPMENT ITEM (A) CONFORMS TO ANY STANDARD IN RESPECT OF SAFETY, POLLUTION, OR HAZARDOUS MATERIAL OR TO ANY STANDARD OR REQUIREMENT OF ANY APPLICABLE AUTHORITY, LAW OR REGULATION, OR (B) IS FIT FOR ANY PARTICULAR PURPOSE OR USE, OR (C) IS MERCHANTABLE OR FINANCEABLE, OR (D) IS OF ANY PARTICULAR CONDITION, SERVICE TIME AND/OR HOURS OF USE, AGE, YEAR OF MANUFACTURE, MODEL, OR MAKE. SELLER SPECIFICALLY MAKES NO REPRESENTATION TO ANY OF THE ABOVE AND HAS ADVISED BUYER OF THE SAME. BUYER AGREES THAT THEY HAVE SATISFIED THEMSELVES, AND IS NOT RELYING ON SELLER IN ANY WAY, NOR IS SELLER LIABLE, FOR ANY MATTER IN RESPECT OF THE ABOVE. BUYER FURTHER AGREES WITHOUT CONDITION TO MAINTAIN AND/OR UPDATE EQUIPMENT TO A SAFE OPERATING CONDITION AND, WITHOUT LIMITATION, TO A CONDITION WHICH MEETS ANY STANDARD OR REQUIREMENT OF ANY APPLICABLE AUTHORITY, LAW OR REGULATION INCLUDING THOSE CONCERNING ANY USE OR FUNCTION TO WHICH THE EQUIPMENT MAY BE PUT. Buyer expressly agrees, furthermore confirms, and accepts that they have received all goods and services owned by the Seller and in full in satisfactory condition without exception. Governing Law and Jurisdiction.
This agreement and sale are governed by and construed under the laws of the State of Arizona, without reference to its conflict of law provisions. Any dispute or claim arising out of or relating to the Agreement, Sale, or claim of breach hereof shall be brought exclusively in the or the Court of Common Pleas of Maricopa County, Arizona. Buyer and Seller hereby agree to consent to the exclusive jurisdiction of such courts and waive any right to challenge jurisdiction or venue in such courts about any suit, action, or proceeding under or in connection with the Agreement or Sale.

Buyer and Seller expressly agree by signing below that ALL SALES ARE FINAL.
